The terms and conditions that follow apply to the use of LosCa.com and it affiliated websites including the mobile version for use by cellular telephones with capability. By accessing the site and using it in any way, you have agreed to the terms and conditions and privacy policy. In addition, by accessing and using this website you have agreed to abide by LosCa.com’s specific guidelines set forth to ensure user privacy and safety of its users. Please read over the terms and conditions and privacy policy carefully as it is the responsibility of the user to know and understand these guidelines prior to utilizing any of the information and/or services depicted on LosCa.com.

2. Eligibility

You must be 18 years of age or older to access and use LosCa.com. LosCa.com is intended to be used by residents of the United States and accessing LosCa.com you have agreed to both of these terms mentioned above. If accessing LosCa.com of behalf of a company, organization or group you must have the authority to abide by these terms collectively for your group.

3. Terms of Service and Privacy Policy are tentative

LosCa.com reserves its right to modify the terms of service and/or privacy policy at any time. When and if changes are made to existing terms or policy it will be available for viewing immediately on this page. The date of last revision of said terms and policy will be available at the bottom of this page at all times. LosCa.com offers its users the capability to create private user accounts in order to post reviews in addition to other features not offered to public users. This requires the user to provide LosCa.com with personal information that will not be sold as defined by the privacy policy. However, the creation of a user account does require the user to keep their passwords confidential. Users are also responsible for all content posted and/or transmitted using their personal accounts. You are required to notifyLosCa.com immediately if you suspect unauthorized use of your user account or of any prohibited content posted by any other user. LosCa.com reserves the right to terminate any user or business user account for ANY reason which includes but is not limited to: explicit content, language, threatening other users etc.

5. Types of Accounts

User Accounts: This is a personal account for non-commercial uses only. This type of account is used to post reviews and participate in other features of the site such as contests and/or sweepstakes. Creating a user account must be done solely for personal reasons you may not impersonate any other person. Users must provide valid e-mail addresses and information. The creation of multiple accounts even if under a different aliases will result in termination of all accounts (including the primary one) to ensure an efficiently running site.

Business User Accounts: This type of account is for use by a representative of a business or organization. In order to create this type of account you must be directly affiliated with or a member of a business or organization and has expressed permission from business administration to register a business account on LosCa.com. All advertising and information posted must adhere to LosCa.com’s guidelines and are subject to the same rules and regulations as mentioned above for personal user accounts. LosCa.com reserves the right to delete any business user account without notice and may or may not notify a paying business of their upcoming account termination depending on the circumstance.

6. Use of LosCa.com

LosCa.com invites users to post unlimited reviews for California businesses, organization or services. This includes rating business performance, downloading coupons for selected businesses, entering promotions and/or contests, social networking with other users in the form of messaging and/or blogging. Reading reviews posted by other members as well as the LosCa.com featured blog. Users are able and encouraged to use LosCa.com as a directory for local businesses as well as make LosCa.com their homepage to check local weather conditions among other features that LosCa.com provides to its users.

Please be advised that as a user of LosCa.com you will be presented with third party content in the form of banner advertizing or general information/advertizing on LosCa.com. This information is not endorsed by or a part of LosCa.com and all contents are third party sponsored. LosCa.com is not responsible for any of the content of our advertisers.

Any breach of this will result not only in termination of account but transcripts will be forwarded to the appropriate authority of necessary.  You may not use LosCa.com to violate any copyright, trademark, trade secret, or privacy policy. You may not use LosCa.com to post, transfer, or e-mail any illegal content or pornography. You may not use LosCa.com to solicit information from minors or use LosCa.com to contact minors. You may not modify, alter, reproduce, or re-create LosCa.com for any reason. You may not reverse engineer any part of LosCa.com. You may not use any robot, spider or similar software to scrape information from LosCa.com.  You may not take any action that could impose a threat to the LosCa.com infrastructure. (i.e. hack into the LosCa.com administration panel etc.)

8. Permission to use user content

By using LosCa.com you grant us permission to use any user content for any purpose. This can include, publishing it, editing it, using it for other works etc.

In addition, LosCa.com may remove any user content that it deems inappropriate and LosCa.com has no obligation to provide a record of user content. LosCa.com does not guarantee user confidentiality if user has violated these guidelines set forth. LosCa.com may also allow advertisements to be placed near or in conjunction with user content; users are not entitled to any compensation from this practice.

The user is solely responsible for all content and cannot infer that LosCa.com endorses any user content. This also means that any repercussions as a result of your content are your responsibility.

10. Copyright Policy

LosCa.com adopts the following policy: Title 17, United States Code, Section 512(c) If you believe that any part of LosCa.com infringes on a copyright please follow these procedures: Write a formal letter to LosCa’s administration including; a description of the alleged copyrighted work, a clear description of where on LosCa.com this infringement occurred, a statement on your behalf that you are in fact the owner of the copyright, (under penalty of perjury), your signature and contact information. If you believe that user content has been mistakenly removed you can do the following; you may send a counter notice to the designated agent stating the following; a summary of the content removed and where it was posted on LosCa.com prior to its removal, a personal statement under penalty of perjury that the content removed was mistakenly done so, consent to allow jurisdiction of the Federal District Court where you reside, (if outside United States jurisdiction will be any district where LosCa.com is located, your signature and contact information.

LosCa.com reserves its right to alter, shut-down and discontinue its services and website at anytime without notice.

LosCa.com exercises its right to lawfully protect its website and database from unauthorized access using (but not limited to) technological barriers and IP mapping. Under some circumstances, LosCa.com will contact service providers to report unauthorized use.

13. Comments, Complains, Questions

If you are dissatisfied with any of the content, usability or have general questions please contact LosCa.com’s customer service agent at customerservice@LosCa.com if we are unable to resolve your matter we advise you to terminate your user account to avoid further problems and absolve the user of following the terms and service.

14. User suggestions

We welcome any user feedback, however LosCa.com is under no obligation to utilize any feedback, nor is LosCa.com obligated to use suggestions in their entirety. LosCa.com can modify or use a similar suggestion without monetary compensation for the original submitter. If user suggestions are used to modify any portion of LosCa.com the user waives their right to the information and suggestion.

LosCa Inc. owns LosCa.com in its entirety including but not limited to, site content, graphics, photos, blogs, reviews, business contact information posted on LosCa.com’s directory, etc. LosCa Inc. owns all copyrights and trademarks associated with LosCa.com. Users may not reproduce copy or use any trademark material for other purposes unless otherwise granted permission by LosCa Inc.

All content on LosCa.com is provided “as is.” And is under no obligation to modify or continue site features at any time. LosCa.com makes no promises, warranties, representations concerning the usability of the website. LosCa.com is not responsible for the accuracy, integrity, or otherwise content of any information on LosCa.com included but not limited to: user reviews, business information, weather forecasting, etc. LosCa.com is not responsible for punitive damages, consequential damages or any other damages as a result of use of the website. All information gathered from LosCa.com is to be used at your discretion and LosCa.com is not liable for any inaccuracies or misrepresentations that may rise from the data contained within LosCa.com.
